This Time Around The Top NYPD Cop Bernard Kerik Goes Down Four Years

New York, NY-Feb 27, 2010. Ex New York Police Department's police commissioner and former NYC Department of Corrections commissioner Bernard Kerik has accepted to do four years of prison for corruption, obstructing justice and lying to then president George Bush when he was tapped as the next director of Homeland Security. The man who was regarded as the 911 New York hero looked devastated and almost wept as he stood with current wife Hara Kerik, Joseph Kerik (A Newark Police Department detective) and other children in front of the press giving his statement.

Originally the New York top cop was offered a plea deal that would get him out of prison in 2 to 3 years if he pleaded guilty. Otherwise he would face three federal trials. The first trial comes after he allegedly got $255,000 in apartment renovations from a mob-linked contractor who was seeking a city permit. The second trial to be held in White Plains is for hiding charges of 300,000 and above for book fees, royalties and free rent from the IRS. The last case is likely to be held in Washington federal court, after Kerik was accused of making false statements when George W. Bush tapped him to become homeland security secretary. Bernard Kerik may plead to 27 to 33 months, but if he goes to trial he could be sentenced to up to 20 years in prison.

Judge Stephen Robinson delivered a sentence of four years, more than the maximum allowed by federal guidelines, after stating: "Most fair people would have to say that the defendant in the aftermath of the September 11 terrorist attacks acted in the highest tradition of a public servant in his position. However, the other side of the picture is not, in my view, so pretty".

Mr. Kerik long time supporter and friend Rudy Guiliani who named him to the NYPD and New York City Corrections Department posts and who lobbied for his Homeland Security job was not present at the time the sentence was read. On May 17, 2010 the fallen hero must start his prison term.

Former NYPD cop and expelled New York State senator Hiram Monserrate was convicted of assault on his girlfriend Karla Giraldo who received eight stitches on her face after the ex-cop broke a bottle on her face. Of the 250 community service hours he was ordered to attend he has completed less than seven hours and as of Feb. 19, 10 he has not been present in the court ordered domestic violence counseling sessions.
His lawyers are trying to overturn the New York State senate's decision to fire him from his state senator position, a position for which the convicted ex-cop was elected. If they do not succeed, on March 15, 10, voters in his Queens, NY district will have a chance to elect a new state senator. Despite having very poor prospects to save his political career, the disgraced senator, who virtually got a writ slap for his jealous attack on his girlfriend, is trying to get on the March 15, 10 ballot in order to get his job back. His attorney Joseph Tacopina stated that "the senator has been compliant with his probation conditions". He has also suggested that the convicted ex-senator's probation is not going to be revoked by the Probation Department.

Hiram Monserrate who served previouly as a councilman, left the NYPD with a psychological disability. He is the first New York State senator to be expelled since 1861. Luckily Karla Giraldo has stuck to his defense claims that the incident was just an accident. Surprisingly Ms. Giraldo has insisted that the convicted senator's actions do not deserve jail. So far he only has to complete his probation term and do community service.

Teen Outsmarts Veteran NYPD Detective

New York, NY-June 25, 09. Bronx detective Christopher Perino, 43, of the 44th Precint Station house will lose his $80,000 annual salary, his $41, 300-a-year potential pension and his freedom after a nonjury trial where he was convicted of perjury in 6/24/09.

Perino lied under oath at Erik Crespo's attempted murder trial where he said he never grilled the 17-year-old teen. However, he failed to discover that Crespo had an MP3 player with which he documented the entire interrogation where the 19 year veteran cop failed to read the teen his Miranda rights.The NYPD cop was convicted by Judge James Kindler and may face up to 7 years in jail. However experts believe he will be sentenced to three to four months.

"Don't make it hard for me, 'cause I could keep you here all night. I can keep you here all tomorrow morning. I can make sure that you don't see the judge for the next three days", Perino said as he interrogated the teen.

Don't Waste Time Calling Your Precint -They Won't Answer

New York, NY-August 3, 09. According to a Daily News report, of the 76 New York City police precints, 32 stationhouses have unacceptable service at answering the phone when called by the public. The report indicates that when you call a precint you are likely to find: " the lines are busy, the phones ring off the hook or that cops pick up the phone and slam it back down". In all 40% of all NYC station houses were deemed "unacceptable".
The worst precints at taking your calls is the Brooklyn 66th Precint, Bronx 44th, 46th and 48th and Manhattan 9th Precint.

"Everybody acts like a boss and doesn't bother picking up the phone", admitted a Brooklyn cop.

NYPD's own spot checks of 2009 found that 19 of the 97 neighborhood cop offices and precints failed to answer promptly.

New York, NY. August 2, 09. An off duty NYPD cop pulled his gun on a bouncer at a Queens, NY bar after he was refused access to the club. Thevor Harpaul, 28, displayed an unlicensed gun with a defaced serial number -the type of gun used by criminals because it is hard to trace- and said:
"Where's your mouth now" to the helpless bouncer. According to the club manager, Officer Harpaul was drunk.

The four year veteran 84th Precint cop was arrested by two NYPD officers who discovered his service hand gun in his car and marijuana. He was charged with weapons possession, reckless endangerment, menacing, possession of marijuana and other counts. It is unknown whether the cop, an East New York resident , will face disciplinary charges.

One of the most serious cases of NYPD police corruption was the mob related indictments brought against decorated NYPD detectives Steven Caracappa and Louis Eppolito who were charged with being paid assassins for the mafia.

Not only are cops being accused of associating with criminals but also some have been exposed by their partners. It is the case of Kenneth Moreno, a 17-year NYPD veteran who allegedly raped a drunk woman on Dec. 7, 08 as his partner Franklin L. Mata stood guard at the woman's apartment in the neighborhood of East Village in the County of New York. Surprisingly, Moreno and Mata were not arrested but placed on modified duty according to NYPD. Details of the case were brought to NYPD's internal affairs thanks to Mata's breaking the famous Blue Wall of Silence - a along standing belief that no cop will denounce other cop- which has been a part of NYPD's culture for decades and hurt its ability to catch corrupt NYPD officers.

If you get a ticket in New York, if you get a criminal court summons, or even if you get arrested and "charged" with a misdemeanor, felony or crime, do not assume that the principle "INNOCENT TILL PROVEN GUILTY" applies here. On the contrary, from our own experience in traffic court in New York, we have concluded that what usually applies is "GUILTY TILL PROVEN INNOCENT". At the start of a hearing in front of a traffic court "judge" at a New York State traffic ticket adjudication court, the first words you will hear if you are contesting an alleged traffic violation is: "If it comes down to your word against the police officer's testimony, I will accept the police officer's testimony as having more weight". In other words, no matter how truthful your testimony may be, the NYPD's officer's words in court are going to sink you, unless you have strong evidence supporting your claim (Sometimes, this evidence may consist of: Catching the police blatantly lying, or openly giving tickets without cause on video, or having a police officer testify against the deponent officer, or having extremely clear photos showing that the accusing officer has misrepresented facts, etc)Therefore you will more likely come out a loser from your traffic court hearing, unless you are an attorney or you have a good attorney or you have an extremely good defense supported by evidence that confirms that the NYPD cop, like hundreds of crooked cops, has lied on his testimony or his summons or his notes.

In real life, many NYPD cops are folks like you and me. They have wives and children and a J-O-B. They use the j-o-b to earn money to support their family, their girlfriend(s), their drinking habits -if any, which is way too common among NYPD-, their drug habits-If any, but too many cops have been exposed for using steroids, pot and other drugs-, their debts and other expenses. They feel the pressure to excel or at least do average work. Part of this average work consists in writing tickets and getting people arrested. Of course, it is also very beneficial for their record to show that all the tickets were substantiated and all the arrests justified. It is here where misrepresentation of facts (lies) play a role. They definitely have to lie in court many times in order to succeed. It has been proven over and over again that the NYPD human resources management cannot ensure that all NYPD cops be honest. In fact there are too many rotten apples in the big apple. These cops will lie, falsify, steal, kill on behalf of the mob, kill because of greed, kill for jealousy, kill to protect their jobs, rape crime reporting victims, threaten blacks and Hispanics, harass young kids, commit perjury so they can appear to be "heroes" and commit dozens of other crimes. If they fail in their effort to escape the legal system or if they get caught openly, they will proceed to commit suicide which is a very irresponsible way of facing the truth. Suicidal cops in New York is a common phenomenom, more common than suicidal civilians if we compare the two groups. So next time you have to deal with a traffic violation, try to be well prepared to face a police supporting judge and a NYPD lying cop willing to whore himself into untruths just to get you convicted.

Today several newspapers in New York published what the whole world knows: A report from the ACLU which claims that complaints against NYPD generally get dismissed or poorly investigated by the CCRB (Civilian Complaint Review Board). The world knows that many of those police corruption stories brought to the silver screen were inspired on the police of New York City. It is a fact that the CCRB acts as a half blind one-legged agency when it is time to investigate and report NYPD abuses against New Yorkers. It claims that about 7 per cent of all complaints brought against New York police officers are "substantiated" which means that they somehow found the accusation against an abusive cop credible. However as of last year, 2006, according to ACLU, which is not one of Bloomberg propaganda outlets, only about 5% of all complaints against NYPD officers were "substantiated". The punishment for the NYPD cop who beat you up: "5 days off his vacation time" or "2 days docketed off his pay". This complacency and leniency that these so called "heroes" enjoy is the product of Union politics, greedy politicians such as Rudolph Guiliani (A.K.A Rudy Bully Guiliani) and a double standard of application of the law. Of course this also brings rookie cops to conclude that "no matter what we do, we will get away with it".

These reports about NYPD not policing itself are not surprising to New Yorkers who see crime on the streets rising while NYPD claims crime stats are down. It is these New Yorkers who see their brothers, friends , or other relatives involved in complaints against NYPD which they know will be found "unsubstantiated" in the end or perhaps ,at best, the guilty officer will get a department hand slap which may be just turn out to be a letter or less vacation time. That is why technically, NYPD police officers act as immune judges and prosecutors when they confront "hood" kids. "This N*** is moving too fast. Wait !!! GUN!!!! .... SHOOOOOOOOT......

Just let's ensure that he gets at least 41 bullets and probably he will not say a thing. DEAD N*** can 't complain" . Is this what crosses through these NYPD union empowered idiots' minds ? If so, then they are just a bunch of cruel coward,cry babies who are afraid of unarmed New Yorkers. That's why they shoot so many unarmed civilians. Death by NYPD cop is always on the rise in New York.

As for double standards, if you kill a cop you are to get a "death sentence" or imprisonment for life. But if one of these SOB kills your father, he will be allowed TWO DAYS without talking to investigators (which is enough time to create a story such as "he had a black wallet and it looked like a gun, so we decided to shoot him FORTY ONE TIMES"); he will allowed to have his "mock" trial in Albany, NY where they have no idea about New York cops abuse and he will be probably punished with one year probation (Which means he will actually be free after the assassination). So it is an unfair system which gives too many privileges and extreme power to more than 35,000 individuals. This power can be lethal . Or ask Caracappa, one of the most celebrated NYPD officers, who was convicted of killing for the mob or ask his partner renowned detective Eppolito who was also convicted for being an assassin for the mob. Of course neither CCRB nor NYPD substantiated the complaints against these "finest" convicted assassins. Instead CCRB turned a blind eye and NYPD just promoted them, as it does with most cops, disregarding their true history. This is only one of dozens of similar cases. It worries us more to know that compared to other Complaint Boards in United States, NY has the lowest rates if it about investigating and finding wrongdoing by New York cops (US complaint boards average more than 10% of "substantiated " cases as opposed to NY which only "substantiates" 5%). It worries me a lot to assume that NYPD has also seen an increase of suicidal cops, which means that the police officer who is pointing the gun at you right now may suddenly turn it to his own head and shoot himself. I hope you survive.

Service of Court Documents on Sundays Possible

Service of process is not an easy task because there are many rules and procedures to follow depending on the state where process service will be effected. For example, certain states like Nevada require licensing if you want to engage in the business of delivering legal documents. On the other hand, there are states such as New Jersey which require specific forms and formats for process serving. On top of that , most states will not accept process service as valid if it is effectuated on Sundays or any other legal holidays, including Saturdays if the recipient keeps the Sabbath (For most Jews and Pentecostal believers, Saturday is a holiday).

What there is no doubt about is the fact that most states agree that service of process is unacceptable on Sundays. However, there are a few exceptions. For instance, in New York State serving certain court orders is completely legal business to do on Sundays. So you New York process servers out there, don't forget that your boss may assign you a weekend job to be done on Sunday on the next defendant who beat up his wife, has a pending order of protection or threatened to harm a relative.
